These Terms of Service govern your access to and use of Everyone Can Hike’s website www.everyonecanhike.com.au. Please read these Terms carefully before using the Site.
1. Acceptance of Terms
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any services.
2. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms.
You agree not to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which may harm Everyone Can Hike or users of the Site or expose them to liability.
3. Booking
Bookings are cancellable with full refund up to 14 days before the event start date.
Within 14 days no refund shall be issued except in the case of being medically unfit for participation. On provision of a medical certificate, individual cases will be considered for either full refund or transfer to another activity.
Full refunds will be awarded in the case of weather deemed unsafe by the Bureau of Meteorology, including damaging winds, flood risk, and bushfire risk.
4. Intellectual Property Rights
The Site and its original content, features, and functionality are owned by Everyone Can Hike and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5. Limitation of Liability
In no event shall Everyone Can Hike, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia and Victoria, without regard to its conflict of law provisions.
7. Changes to Terms
Everyone Can Hike reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
